Student Enrollment Agreement – Terms and Conditions

You have enrolled in a program of Manipal ProLearn offered by Manipal Global Education Services Private Limited (“Manipal”, “we”, “us”, “our”) for the purpose of acquiring knowledge and skills.All program techniques and materials (online and print) are the exclusive property of Manipal.

You agree not to disclose, reproduce, sell or distribute to any third party any information (written or oral), including course materials, obtained from Manipal in connection with Manipal courses or tutoring programs.

You further understand that the classroom course size for some of the courses is limited and therefore, enrollment is taken on a first-come, first-served basis.

Program Payment

 

You must pay the program fee at the time you enrol. If you enrol in a classroom course, you shall within ten (10) days before start of that program, or if you enrol in a Manipal online course, you may pay in full at the time of enrolment. If you have not paid in full by ten days prior to the first scheduled session of the classroom program, you authorise Manipal to charge the fees in full to your account or opt out of the classroom program.

The price for the courses published is inclusive of Service Tax 14% ,0.5% Swachh Bharat Cess and 0.5 % Krishi Kalyan Cess.

All prices, products and offers of Manipal website are subject to change without notice. While we make sure most accurate and up-to-date information, in some instances one or more of our prices may be priced incorrectly. This might happen due to digital images, technical errors, or a mismatch. Manipal reserves the right to change prices for all our programs, offers or deals. These changes are done due to market conditions, course termination, price changes, inadvertent errors.

Student Withdrawals and Refunds:

 

We try our best to ensure that our users have a rewarding experience while they discover, assess, purchase and experience our courses. If you choose to withdraw your enrolment in a Classroom / Instructor Led online training course seven (07) or more days before the first scheduled session of your program, we will refund all of the Program Fees you have paid, less 10% of the total program fees paid for each respective Classroom / Instructor Led online training program towards administration charges. No refunds will be given if cancellation is informed to us less than seven (07) days of the first scheduled session of the Classroom / Instructor Led online session of the training program to which you are enrolled.

If you choose to withdraw your enrolment in any online self-learning programs within 48 hours after your enrolment in such online program, and further you have not accumulated more than thirty (30) minutes of online training program) we will refund all of the Program Fees you have paid, less a 10% of Program Fee towards administration charges. It is to be noted that no refunds are entertained after 48 hours from the time of enrolment for any our online programs or where you have accumulated more than thirty (30) minutes of online training program to which you have enrolled and are provided access. Instead of receiving a refund you may further wish to keep with us a credit of the balance Program Fees and use the same in your next program enrolment with Manipal. It may be noted that the Program Fee credits available as aforesaid are non-transferable and valid for the period as described for respective Programs.

In order to receive a refund as set forth above for classroom training, you must return any program materials for classroom sessions you received to us unopened and no marks on the materials within two (2) weeks of your withdrawal of your enrolment. Courier / postage costs for return of materials are at your expense. If you fail to return you program materials within two weeks or do not return them unopened and unmarked and;

  1. If you are registered for a classroom course, Manipal will deduct your deposit from any refund that you are eligible, or
  2. If you were registered for an Online course and you are otherwise eligible for a refund, Manipal will deduct the full price of the course.

Rescheduling Policy

 

Manipal, reserves the right to postpone/cancel an event, or change the location of an event because of insufficient enrolments, similar force majeure events or from any like cause beyond our reasonable control, including without limitation, mechanical, electronic or communications failure or degradation.

The rescheduling policy applies only in case of programs with classroom sessions / instructor-led online training. In case Manipal reschedules the first scheduled program classroom event/instructor led training, the options available to you are:

  1. 100% refund of the program fees paid, and subject to the following, if the rescheduled dates do not fit your schedule over subsequent four (4) weeks from the date of such rescheduled request
  2. You would have the privilege of rescheduling and attending a class in future at your convenience, at any location, on any date of a scheduled classroom training/ instructor led training, provided that only one (1) such re-scheduled request will be accepted for a particular classroom session / instructor-led online training;
  3. You, if you wish can send a rescheduling request. However, this should be intimated to Manipal at least three (3) days prior to the first scheduled classroom event/instructor led training.
  4. Whereas, if for some unforeseen reasons, you wishes to reschedule your registration to a future date prior to the first scheduled classroom event / instructor led training, a rescheduling fee is charged as mentioned below:
    1. If the rescheduling request is received 7 days prior (or more), 10% of program registration fee will be charged towards rescheduling charges.
    2. Please note that rescheduling at scheduled classroom events will be subject to availability of seats at the classroom session / instructor-led online training session during your proposed schedule.
    3. If the request of rescheduling of the classroom event / instructor led training is received within seven (7) days or less prior to the first scheduled program classroom event / instructor-led online programs, no rescheduling will be allowed nor any request for refund of program fees paid will be accepted.

Program Cancellation

 

Occasionally, due to various circumstances, Manipal may change course schedules or locations, cancel a course. If we cancel the course in which you have enrolled and are not able to reschedule you into another course that is acceptable to you, or if we are unable to match you with a classroom session, we will refund all of the course fees you have paid (including your deposit), and we will have no further liability to you with regard to the cancelled program. If you have received any program materials, you must return them to us at our expenses for postage in accordance with Manipal’s return authorisation policy, within two weeks of the program cancellation. If you fail to return you program materials within two weeks or do not return them unopened and unmarked and;

  1. If you are registered for a classroom course, Manipal will deduct your deposit from any refund that you are eligible, or
  2. If you were registered for an Online course and you are otherwise eligible for a refund, Manipal will deduct the full price of the course.

Please note that refunds for cancellations under this or the immediately preceding section take approximately 30 days from notification of cancellation to be processed.

Dismissal from Program or Online Access:

 

Manipal may dismiss you from the program if you have not paid in full by first scheduled session or if you, in Manipal’s option, are disruptive in the program. Manipal will not refund any amounts paid by students who are dismissed from a program. Manipal may also disable access to any online resource we provide if you do not comply with our terms of use or other rules and procedures applicable to such resource. In such an event, you will not be given any credit or refund.

You will have access to the enrolled Online Courses for the duration of respective Course you have enrolled, but not exceeding a maximum period of three (3) months (Except Digital Marketing Professional Program which will have 5 Months course validity. CIMA - Advanced Diploma in Management Accounting , CIMA Gateway Prep Program & Bank Probationary Officer (PO) Exam Coaching & its variants which will have 6 Months course validity) from the date of first enrolment by you for a Course as per enrolment confirmation, whichever is later..

Post the completion of course validity period, the course access will be deactivated on our portal http://edunxt.manipalprolearn.com . However you will continue to have access to your profile account, solely for the purpose of downloading your E-Certificate, which is available upon successful completion of your Manipal ProLearn Course and updating your personal details with us, in order to receive future communications from Manipal.

Limitation of Liability

 

Manipal will not be liable to you or to any other person for any indirect, consequential, punitive or special damages, of any character, whether in an action in contract, tort or otherwise, arising out of or in connection with your program, unauthorised access to or alteration of your transmissions or data or confidential information, even if Manipal has been advised of the possibility of such damages. Manipal’s total aggregate liability arising from or related to your program will not exceed the amount you paid for your program.

We make no warranties of any kind, expressed or implied, with respect to any programs or services sold on or through Manipal.

Governing Law

 

This enrolment agreement and any claim or dispute arising out of, relating to or in connection with this enrolment agreement or the transactions contemplated hereby, whether in contract, tort or otherwise, shall be governed by and construed in accordance with the laws of India, without giving effect to its conflicts of law principles.

Acceptance of these terms and conditions:

 

I understand that by checking the “I Agree to Enrollment Terms” checkbox when prompted, I acknowledge that I have read and that I agree to the enrolment terms and conditions. Note that you must be 18 years of age or older to accept these terms and conditions. If you are less than 18 years of age, you must have a parent or guardian accept on your behalf. Checking the “I Agree” checkbox is a representation from you that you are atleast 18 years of age.
